My opinion: You can choose to smoke, or choose not to. Based on that, they can choose to hire you, or choose not to.

The rest of the protected classes aren't really a "choose to do it" sort of thing.

You could make a case people choose to have children or not, but it's such a basic part of life so I don't think it should count.

Yes it's perfectly legal and the company has a right to do it. Companies can set their own standards for their employees. Smoking is a choice and if you want that job then your choice better be to not smoke.

The government wants to fix healthcare? How about eliminating 1/3 of all cancer cases by getting rid of smoking. 1/3 of all Oncologists could go to work treating other diseases and illnesses.

Do I need to bring in the higher risk factors for heart attack and stroke that are attributed to smoking?

Oh, and to you smokers, nice job on working hard to eventually have a face that looks like a catcher's mitt. And good luck selling your used car to a non-smoker, since it probably reeks like a used ashtray.

I would argue someone on dispatch can't be running outside for a smoke.

And I, too, am a smoker. And the holier-than-thou types just make me want to go have a smoke

What test are they going to give every smoker applicant to determine if they can go X hours without needing to smoke?

And let's say they take your word on it, you know because you are obviously a trustworthy person... maybe you can make it X hours... but in those last 30 minutes you are going crazy because you need your fix? For 30 minutes you are operating at sub-par performance levels.

No, what I'm saying that the people doing the hiring DON'T KNOW YOU.... but they do have statistics on smokers in general.

Sure, you may be an exception to the rule, but to hire you, they would have to have some method of determining that you are the exception. Why go through that much work to determine that when they can easily find someone that they don't have to take a chance in that particular regard?

I believe breaks are every 4 hours. I don't know too many smokers who can go 8 hours with 2 opportunities to smoke without having withdrawal symptoms. If that is the case, get a patch.

Perhaps the stench that comes back on a person from a smoke break is offensive to others or perhaps someone else has an allergy.

If you want it that bad, just apply and say you don't smoke. Go somewhere they can't see you on your break and permanently damage your lungs in solitude

If they ask why you smell say you went to a bar.

Bullcrap on addiction being just physical. There's a huge mental aspect to it too. I smoked for 4 years, one day I decided to quit. and never smoked after that. Why? Because I told myself to.
